Terms and Conditions
These Terms and Conditions apply to the use of services and platforms and technologies provided by Platinum Payment Serviceor behalf of Platinum Payment Service to users. In this document Platinum Payment Service, Inc., a Delaware corporation may refer to ourselves as “Platinum Payment Service”, “we”, “us”, “our”. We may refer to consumers of Platinum Payment Service as “you”, “your”, “Merchant” or “users”.
Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who wish to access or use the Service.
By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you do not have permission to access the Service. Merchants and consumers of the services shall also be bound by terms and conditions which apply to Payment Gateways, Processors, or as part of Payment Facilitation.
SUBSCRIPTIONS
Some parts of the Service are billed on a subscription basis (“Subscription(s)”). You will be billed in advance on a recurring and periodic basis (“Billing Cycle”). Billing cycles are set on a monthly basis.
At the end of each Billing Cycle, your Subscription will automatically renew under the exact same conditions unless you cancel it or Platinum Payment Service cancels it. You may cancel your Subscription renewal either through your online account management page or by contacting Platinum Payment Service customer support team.
A valid payment method, including credit card, is required to process the payment for your Subscription. You shall provide Platinum Payment Service with accurate and complete billing information including full name, address, state, zip code, telephone number, and a valid payment method information. By submitting such payment information, you automatically authorize Platinum Payment Service to charge all Subscription fees incurred through your account to any such payment instruments.
Should automatic billing fail to occur for any reason, Platinum Payment Service will issue an electronic invoice indicating that you must proceed manually, within a certain deadline date, with the full payment corresponding to the billing period as indicated on the invoice.
FEE CHANGES
Platinum Payment Service in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.
Platinum Payment Service will provide you with a reasonable prior notice of any change in Subscription fees to give you an opportunity to terminate your Subscription before such change becomes effective.
Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.
REFUNDS
Certain refund requests for Subscriptions may be considered by Platinum Payment Service on a case-by-case basis and granted in sole discretion of Platinum Payment Service.
ACCOUNTS
When you create an account with us, you guarantee that you are legally permitted to open the account and enter into contract with the service and that the information you provide us is accurate, complete, and current at all times. Inaccurate, incomplete, or obsolete information may result in the suspension or immediate termination of your account on the Service.
You are responsible for maintaining the confidentiality of your credentials (account and password), for yourself as well as individuals granted access by you to perform actions on your behalf. The confidentiality of your credentials includes but is not limited to maintaining the security of your electronic devices such as mobile devices and computers and other credentials such as email which may be used to gain access to the Service . You agree to accept responsibility for any and all activities or actions that occur under your account and/or password, whether your password is with our Service or a third-party service. You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account or accounts which have access to act on your behalf
You may not use as a username the name of another person or entity or that is not lawfully available for use, a name or trademark that is subject to any rights of another person or entity other than you, without appropriate authorization. You may not use as a username any name that is offensive, vulgar or obscene.
LINKS TO OTHER WEBSITES
Our Service may contain links to third party web sites or services that are not owned or controlled by Platinum Payment Service(“Third Party Sites”).
Platinum Payment Service has no control over, and assumes no responsibility for the content, privacy policies, or practices of any Third Party Sites. We do not warrant the offerings of any of these entities/individuals or their websites.
You acknowledge and agree that Platinum Payment Service all not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such Third Party Sites.
We strongly advise you to read the terms and conditions and privacy policies of any Sites prior to their access or use.
THIRD PARTY SERVICES AND MATERIALS
Parts and features of our Service may include, incorporate or integrate with third party software and other third party components and materials (“Third Party Materials”) that are available to you subject third party license terms. Similarly, parts and features of our Service enable you to import, export and otherwise utilize information to, from and between our Service and certain third party software services (“Third Party Services”).
By using our Service, you agree to allow Platinum Payment Service to transfer the content and information you provide to and from the Third Party Services. You acknowledge and agree that Platinum Payment Service cannot control and shall not be responsible to you for any damage or loss you suffer through the use of any Third Party Materials or Third Party Services. Any use of our Service with any Third Party Materials or Third Party Services is done at your risk and any agreement for your use of Third Party Materials or Third Party Services is between you and the owner or provider of such Third Party Materials or Third Party services. You should review the policies and terms of use of all Third Party Materials and Third Party Services prior to their access or use. No policies or terms of any Third Party Materials or Third Party Services shall modify these Terms. You acknowledge and agree that Platinum Payment Service might suspend, modify or terminate any access to, integration with or incorporation of any Third Party Materials or Third Party Services at any time in its discretion. No access to, integration with or incorporation of any Third Party Materials or Third Party Services made with or through our Service means Platinum Payment Service has any affiliation, sponsorship, endorsement, approval, investigation, verification or monitoring by any third party owners or providers of such Third Party Materials or Third Party Services.
You agree not to, directly or indirectly: (a) reverse engineer, decrypt, decompile, decode, disassemble, or otherwise attempt to obtain the source code to any Third Party Materials or Third Party Services, (b) rent or time share or host any Third Party Materials or Third Party Services, (c) remove or destroy any copyright or trademark notices, proprietary markings or confidential legends placed upon or contained within any Third Party Materials or Third Party Services, (d) engage in any activity with our Service and/or any Third Party Materials or Third Party Services that interferes with, disrupts, damages, or accesses in an unauthorized manner the servers, networks, or other properties or services of any third party, (e) use our Service and/or any Third Party Materials or Third Party Services in any way in furtherance of criminal, fraudulent, or other unlawful activity. You agree to hold Platinum Payment Service harmless from any damage or loss suffered by Platinum Payment Service from any violation by you of any of the preceding.
TERMINATION
Platinum Payment Service may at our discretion terminate or suspend access to your account. Access may be terminated for multiple reasons including but not limited to the breach of the terms and conditions and misuse. Prior notice is not required in order to terminate access to the service.
Should you wish to terminate usage of the service, you must notify Platinum Payment Service in writing and you are responsible for any outstanding fees which have been accumulated up to that point.
All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.
